Lately it seems most mashups are pop on pop. Not necessarily a bad thing, but many of us want wide stylistic variety. No worries, tho', the tracks are out there. Ya just got'ta look around.

As you all know the untimely passing of Terry was unexpected, even by
him. We all knew he had cancer but we all thought he had some years
left. So some of us who have worked closely with him over the years are
scrambling around trying to figure out what to do. My job, among other
things, is to establish communications with the Bartcop community and
provide email lists and groups for those who might put something
together. Those who want to play an active roll in something coming from
this, or if you are one of Bart's pillars, should send an email to

Fox "News" Suffers Major Legal Defeat

On Tuesday, a New York federal judge issued a significant "fair use" ruling, and in the process, handed Fox News a major legal loss in its attempts to protect its news shows from exploitation.
The lawsuit concerns TVEyes, which might not be widely known, but is used by MSNBC, ABC, CBS, Reuters and Bloomberg to monitor what is being said on Fox News and more than 1,400 other television and radio stations. Besides use by media organization, TVEyes' clients also include the White House, 100 members of Congress, the Department of Defense, the American Red Cross, AARP, Goldman Sachs, the Association of Trial Lawyers and many others.
These customers create customized search terms and are able to get access to transcripts and video clips. Fox News has warned that such a service - because it also allows those who pay a flat fee of $500 a month to watch live streams - will erode its ratings and "decimate" its business.
As anyone who watches MSNBC knows, Fox News clips are often shown widely in the media. In this lawsuit, Fox News expressed concern that TVEyes competes with its own authorized clip service, which has deals with Yahoo, Hulu and YouTube. What's revealed in today's ruling is that Fox News licensees must agree they will not show clips in a way that is derogatory or critical of Fox News.
With that backdrop, U.S. District Judge Alvin Hellerstein had to examine TVEyes and figure out whether it was a copyright-infringing machine (somewhat but not exactly analogous to what the Supreme Court had to say about Aereo) or whether it served some form of purpose that put it outside the realm of a copyright holder's exclusive rights. Hellerstein takes the latter view, determining that it's closer to Google's efforts to digitize books than Meltwater's efforts to scrape online news stories.

Atheist Must Swear To God -- Or Leave

The US Air Force has told a sergeant he will have to leave the military unless he agrees to take an oath with the phrase "so help me God," officials said Tuesday.
In the latest religious controversy to roil the air force, the atheist airman last month was denied his request to re-enlist because of his refusal to swear to God -- and he is now poised to take the military to court, his lawyer said.
With the deadline for re-enlisting expiring in November, the technical sergeant at Creech Air Force base in Nevada -- whose name has not been released -- will be forced to sue the government in a federal court.
In the past, an airman could opt for an alternative phrase and omit the words "so help me God," but the US Air Force changed its policy in October 2013.
The other branches of the American military do not require the reference to God and make the phrase optional.

Broadway League Backs Down
Joan Rivers
The Broadway League, which represents theatre owners and producers, reversed itself Tuesday and chose to get Broadway's theatres to dim their lights in honour of Joan Rivers.
The league had said Monday that Rivers did not meet the criteria for the honour, triggering a controversy when several theatre owners said they would turn off their marquee lights Tuesday anyway. An online petition was launched and several celebrities came out in favour of granting the honour.
The league changed course Tuesday afternoon, saying the lights would dim at 6:45 p.m. for one minute.
Before the league's reversal, 10 theatres - out of 40 - were set to break with the league and dim their lights. And theatre producer Tom D'Angora had started an online petition asking the league to reverse its decision. It had attracted more than 5,000 signatures before the league changed its mind.

Six Flags Roller Coaster
Colossus
The Colossus roller coaster at Six Flags Magic Mountain has partially fallen down to the ground after going up in flames on Monday.
The iconic roller coaster was damaged after a fire ravaged its wooden structure. The Los Angeles County Fire Department was called to the park on Monday afternoon, and quickly contained the blaze that broke out while crews were working on the ride.
In a lucky turn of events, the 36-year-old roller coaster had been closed for 3-weeks for renovations. The plan was for it to reopen as a new ride, "The Twisted Colossus," for the 2015 season.
In a statement, the park assured the public that this was an isolated incident. "There are no injuries and the fire is contained," said Six Flags. "Colossus is currently undergoing a transformation and has been closed since Aug. 17."

Disappointed In Obama

Michael Moore sees President Obama's legacy as set. The progressive documentary filmmaker couldn't help but express his disappointment with the legislative accomplishments of the politician.
"When the history is written of this era, this is how you'll be remembered: he was the first black president," Moore said during a discussion at The Hollywood Reporter's video lounge at the Toronto Film Festival.
"OK, not a bad accomplishment, but that's it," the director said. "That's it, Mr. Obama. 100 years from now, 'he was the first black American that got elected president' and that's it. Eight years of your life and that's what people are going to remember. Boy, I got a feeling, knowing you, that -- you'd probably wish you were remembered for a few other things, a few other things you could've done."
"So, it is, on that level, a big disappointment," Moore said.

High Price For Fighting Records Requests

New Jersey Gov. Chris Christie's administration has paid out more than $400,000 to reimburse plaintiffs' attorneys in open records request cases since 2012, new records show.
The information, obtained through the state's Open Public Records Act, shows the state paid out more than $441,000 reimbursing plaintiffs' lawyers fees in 23 cases pertaining to requests from January 2012 through Aug. 7 of this year that wound up in court. The sum does not include other costs to the state, such as government lawyers' time.
"It's a half-a-million dollars of wasted money," said Attorney Bruce Rosen, who received one of the payments. "It boggles the mind," he added, because in all of the cases, the plaintiffs were ultimately found by the courts to be entitled to the records.
Attorneys representing media organizations and government watchdogs in cases filed in search of public records have complained that Christie's administration routinely stonewalls even the most basic requests, from out-of-state travel records to visitor logs at the governor's mansion. They say the situation has grown worse this year.

Lawyers for Rick Perry (R-Ethically Challenged) invoked a former Roman emperor and 17th-century French King Louis XIV in a motion filed on Monday seeking to dismiss abuse-of-power felony charges leveled against the Texas governor.
It was the second motion seeking to dismiss the charges against Perry, a potential candidate in the 2016 Republican presidential race, who has tried to rally support by saying he is the victim of a partisan, politicized prosecution.
The new motion argues that Perry was operating within his rights in vetoing money for a public integrity unit in the prosecutor's office in Travis County, a Democratic stronghold in the heavily Republican state.
Since being indicted last month, Perry has traveled to crucial presidential primary states to rally support for a possible campaign. After flaming out in a gaffe-prone 2012 presidential bid, Perry has ranked near the bottom in surveys of Republican voters among possible candidates in 2016.

When Marlo Dewing went shopping for a car last year, she only had one requirement: a manual transmission.
That made her shopping list a very short one. Only around 10 percent of vehicles made in North America now have manual transmissions, down from 35 percent in 1980. And that number is expected to keep shrinking, according to the consulting firm IHS Automotive.
Improvements in the function and fuel economy of automatic transmissions have essentially killed the manual in the U.S., says Jack Nerad, the senior editor of Kelley Blue Book. Some of the country's best-selling sedans - the Toyota Camry, Nissan Altima and Ford Fusion - don't even offer manual transmissions because so few buyers want them. Even some sporty cars, like the Jaguar F Type, come only with automatics.
Manuals no longer have a fuel economy advantage. The five-speed manual transmission on the 2014 Honda Civic sedan gets 31 miles per gallon in combined city and highway driving, for example, while a Civic with Honda's continuously variable automatic transmission - which moves automatically to the gear most appropriate for the car's situation - gets 33 mpg.
The price gap does remain. A Honda Accord with an automatic transmission costs around $800 more than a manual one, while drivers opting for an automatic transmission on a Chevrolet Corvette Stingray have to pay $1,725 more. But that doesn't seem to have stifled demand.

Finds Explorer Ship Lost In Arctic

One of two British explorer ships that vanished in the Arctic nearly 170 years ago during a search for the fabled Northwest Passage has been found, Canada's prime minister announced Tuesday in a discovery that could unlock one of history's biggest mysteries and swell Canadian pride.
Last seen in the 1840s while under the command of Rear Adm. Sir John Franklin, HMS Erebus and HMS Terror have long been among the most sought-after prizes in marine archaeology and the subject of songs, poems and novels.
Franklin and 128 hand-picked officers and men disappeared after setting out in 1845 for the Northwest Passage, the long-sought shortcut to Asia that supposedly ran from the Atlantic to the Pacific by way of the harsh, ice-choked Arctic.
Historians believe the ships were lost in 1848 after they became locked in the ice near King William Island and the crews abandoned them in a hopeless bid to reach safety. Inuit lore tells of "white men who were starving" as late as the winter of 1850 on the Royal Geographical Society Island.
Dozens of searches by the British and Americans in the 1800s failed to locate the wrecks, and some of those expeditions ended in tragedy, too. But they opened up parts of the Canadian Arctic to discovery and ultimately spied a Northwest Passage, though it proved inhospitable to shipping because of ice and treacherous weather.

'Exceptional' 232-Carat White
Diamond
A 232-carat white diamond worth as much as $20 million has been discovered at a South African mine famed for its big-gem finds, owners said Tuesday.
Petra Diamonds said the "exceptional" jewel was found at Cullinan, east of Pretoria, which has supplied stones for Britain's crown jewels and where the world's largest diamond was unearthed more than a century ago.
In 1905, the world's biggest diamond -- the 3,106-carat "Cullinan" -- was discovered there, and later cut into two pieces to be included in the British crown jewels.
The last white diamond sold by the company was a 507.3 carat which went for $35.3 million dollars in 2010, the highest price ever paid for a rough diamond, spokesperson Cathy Malins said.
