As you all know the untimely passing of Terry was unexpected, even by him. We all knew he had cancer but we all thought he had some years left. So some of us who have worked closely with him over the years are scrambling around trying to figure out what to do. My job, among other things, is to establish communications with the Bartcop community and provide email lists and groups for those who might put something together. Those who want to play an active roll in something coming from this, or if you are one of Bart's pillars, should send an email to active@bartcop.com.

After the Saginaw Chippewa fired a housekeeper at the Soaring Eagle casino in 2010, the Michigan tribe found itself at the center of a national legal battle over the reach of U.S. labor law and the sovereign rights of Native American tribes.

The housekeeper, Susan Lewis, was fired for soliciting union support among workers at the casino in central Michigan. She challenged her dismissal before the U.S. National Labor Relations Board, which ordered the casino to reinstate Lewis.

The Saginaw Chippewa refused, saying the NLRB, which oversees union elections and referees private-sector labor relations disputes, had no right to meddle in tribal business.

At issue are two long-held legal principles. One is the right of private-sector workers to band together and pursue union representation, as embodied in the 1930s National Labor Relations Act (NLRA), which the NLRB oversees.

The other is tribal sovereignty, which has been affirmed by Supreme Court decisions going back to the 1820s.

Damaged By Fire

Big Bunny

Dutch artist Florentijn Hofman's giant white rabbit, which drew more than two million visitors on show in Taiwan, was partially damaged by a fire when workers were trying to dismantle it, organisers said Monday.

The left hand, left ear and part of the torso of the rabbit, designed exclusively for the 11-day show in northern Taoyuan county that ended on Sunday, were burnt after a fire started on the lawn where it was being displayed, organisers said.

The cause of the incident is being investigated while officials suspected that the engine of a truck used to remove the rabbit might have overheated and caused the fire, they added.

The beaming bunny, which was 25 metres (82.5 feet) tall and made of waterproof paper material, wood and polystyrene, was to be recycled after the show.

The creation was inspired by ancient Chinese folklore about a goddess who lived on the moon and her companion -- a rabbit which constantly pounded the elixir of life for her.

The rock that crashed onto Earth over a century ago, known as the Nakhla meteorite, has been identified by previous studies as having come from the Red Planet and has been dated at 1.3 billion years old. The research team discovered that deeply embedded within the rock are what looks like egg-shaped, 'cell-like' structures that are believed to have once held water.

"In many ways it resembled a fossilized biological cell from Earth but it was intriguing because it was undoubtedly from Mars," explained study co-author Ian Lyon, planetary researcher at the University of Manchester in a press statement.

While the authors of the study, published this week in the journal of Astrobiology, are not necessarily suggesting this is indeed direct evidence of Martian life itself, it may very well point to the barren planet having a habitable environment in its ancient history. And it looks like asteroid impacts could have actually helped created suitable conditions for microbes to survive - at least temporarily.

Apple Lets Customers Delete Free Album

Apple Inc., after facing complaints from some customers unhappy with receiving a free copy of U2's new album, said it has created a way for users to permanently delete it from their accounts.

The Cupertino, California-based company's move follows the giveaway of the U2 album to half a billion users of its iTunes software last week. The free album was announced alongside new iPhones and a wearable device called Apple Watch. U2's "Songs of Innocence," featuring 11 songs, is free to active iTunes account holders and those who sign up within five weeks, the company said then. The album began appearing in users' libraries within a day or so after it was announced.

Depending on a user's settings, "Songs of Innocence" could automatically download to some Apple devices, taking up valuable space. For others, the album just appeared as available for download among a list of other records users had bought through iTunes.

Apple said today on its website that once the album has been removed from a user's account, it will no longer be available to re-download as a previous purchase. The album remains free until Oct. 13, when it will be available for purchase after that.

Wealth Gap

Income inequality is taking a toll on state governments.

The widening gap between the wealthiest Americans and everyone else has been matched by a slowdown in state tax revenue, according to a report being released Monday by Standard & Poor's.

Even as income for the affluent has accelerated, it's barely kept pace with inflation for most other people. That trend can mean a double-whammy for states: The wealthy often manage to shield much of their income from taxes. And they tend to spend a lower percentage of it than others do, thereby limiting sales tax revenue.

As the growth of tax revenue has slowed, states have faced tensions over whether to raise taxes or cut spending to balance their budgets as required by law.

"Rising income inequality is not just a social issue," said Gabriel Petek, the S&P credit analyst who wrote the report. "It presents a very significant set of challenges for the policymakers."

Quakes

The deep injection of wastewater underground by energy companies during methane gas extraction has caused a dramatic rise in the number of earthquakes in Colorado and New Mexico since 2001, U.S. government scientists said in a study released on Monday.

The study by U.S. Geological Survey researchers is the latest to link energy production methods to an increase in quakes in regions where those techniques are used.

Energy companies began producing coal-bed methane in Colorado in 1994, then in New Mexico five years later. The process creates large amounts of wastewater, which is pumped into sub-surface disposal wells.

Scientists have long linked some small earthquakes to work carried out below ground for oil and gas extraction, which they say can alter pressure points and cause shifts in the earth.

The new study, published in the Bulletin of the Seismological Society of America (BSSA), focused on the Raton Basin, which stretches from southern Colorado into northern New Mexico.

Low-Dose Antibiotics

Major U.S. poultry firms are administering antibiotics to their flocks far more pervasively than regulators realize, posing a potential risk to human health.

Internal records examined by Reuters reveal that some of the nation's largest poultry producers routinely feed chickens an array of antibiotics - not just when sickness strikes, but as a standard practice over most of the birds' lives.

In every instance of antibiotic use identified by Reuters, the doses were at the low levels that scientists say are especially conducive to the growth of so-called superbugs, bacteria that gain resistance to conventional medicines used to treat people. Some of the antibiotics belong to categories considered medically important to humans.

The internal documents contain details on how five major companies - Tyson Foods, Pilgrim's Pride, Perdue Farms, George's and Koch Foods - medicate some of their flocks.

The documented evidence of routine use of antibiotics for long durations was "astonishing," said Donald Kennedy, a former U.S. Food and Drug Administration commissioner.

DuPont

DuPont will pay a $1.85 million penalty to resolve allegations that the global chemical company did not properly disclose the risks of using one of its herbicides, leading to widespread damage to tree species through several U.S. states.

The U.S. Environmental Protection Agency (EPA) ordered DuPont to stop selling the herbicide, Imprelis, in August 2011 after the agency received more than 7,000 reports of tree damage or death tied to its use. Damage to trees, primarily Norway spruce and white pine, was reported throughout Indiana, Illinois, Michigan, Minnesota, Ohio, Wisconsin and several other Midwest states.

The company marketed the herbicide for lawn and turf applications on residential and commercial lawns, golf courses, sod farms, schools, parks, and athletic fields. It was designed to control weeds such as dandelions, clover, thistle, plantains and ground ivy.

The EPA found DuPont failed to submit reports on the potential adverse effects of Imprelis, and sold it with labeling that did not ensure its safe use.

Last month DuPont agreed to pay a fine of $1.275 million and spend an estimated $2.3 million more to settle claims by U.S. officials that it failed to prevent toxic releases of hazardous substances in West Virginia.

The International Whaling Commission (IWC) gave aboriginal Greenlanders the go-ahead Monday to kill hundreds of whales even as Iceland came under fire for contravening a ban on commercial hunting.

The commission's 65th meeting kicked off in Slovenia with a vote of 46 to 11, with three abstentions, in favour of Greenland's proposed 207 kills per year from 2015 to 2018.

The issue was an agenda-topping item, with conservationists fearing much of the meat meant for aboriginal subsistence was actually being sold.

"More than 800 whales were condemned today just in the Greenland vote," Wendy Higgins of the Humane Society International (HSI) told AFP on the first day of the controversy-laden gathering in Slovenia.
