NBC Clearing Roots Songs

Questlove

NBC is now checking the songs the Roots play on "Late Night with Jimmy Fallon" after the band performed an off-color song during Michele Bachmann's show appearance last month.

Ahmir "Questlove" Thompson of The Roots says now he's "gotta clear a lot of the song choices" with the network.

"It's still a comedy show, so they promise not to step on my toes or that type of thing, but they definitely want to know the title of the song, the subject matter of the song, can it be seen as an insult?" he said in an interview Thursday.

"It was kind of wrong for me to throw (NBC) under the bus without telling them what it was, so I understand from a business standpoint," Thompson said.

MythBusters

The hosts of the popular Discovery Channel show MythBusters visited a Dublin neighborhood on Wednesday to apologize for the misfired cannonball that rocketed through a home and smashed a minivan window in the area the day before.

Reality television show hosts Adam Savage and Jamie Hyneman came to the home to see the damage their cannonball inflicted.

The pair spent several hours investigating the damage and helping to clean up at the house, leaving around 4 p.m. after they promised the homeowners they would take care of the mess.

They still don't know exactly how the projectile ended up hundreds of yards from the shooting range where the experiment was being conducted.

Apple's Founding Contract

The contract that established Apple as a corporate entity in 1976 and another document, signed 11 days later, that removed one of the partners are expected to fetch up to $150,000 when they are auctioned next week by Sotheby's.

The December 13 auction of books and manuscripts will also include a letter from Franz Kafka complaining of writer's block, a set of cartoons from Playboy founder Hugh Hefner and a telegram announcing the sinking of the Titanic in 1912.

But the sale of the Apple Inc contract, available several months after the death of co-founder Steve Jobs in October, is expected to be the biggest draw.

The contract establishes the Apple Computer Company and states that Jobs and Steve Wozniak will each be given 45 percent of Apple's shares. Ronald Wayne, who drafted the contract, was given 10 percent.

Yanked From ABC Schedule

"Man Up"

"Man Up" has been shot down by ABC.

The network has pulled the freshman comedy from its schedule, the network confirms to TheWrap. Repeats of "Last Man Standing," which has been preceding the show, will now occupy the Tuesdays at 8:30 p.m. timeslot.

Five episodes of the series remain unaired, and while the network plans to air them at a later date, there are no specifics as of yet.

The series, which premiered to a soft 2.4 rating/6 share in the adults 18-49 demographic in October, has declined since then -- the most recent episode this week posted just a 1.6/4 in the demo, with 4.7 million total viewers.

A federal judge has ruled that a Montana blogger was not acting as a journalist when she posted inflammatory statements about an Oregon attorney and that she is not protected from a $2.5 million defamation judgment.

The ruling last week by U.S. District Judge Marco Hernandez is seen by outside observers as potentially having chilling effects on other bloggers.

The case stems from a lawsuit filed on January 14 against Eureka, Montana-based blogger Crystal Cox that accused her of defaming Oregon attorney Kevin Padrick with writings on her website that called him "very corrupt" and falsely suggested he may have hired a hitman to kill her, court papers state.

Hernandez, a federal judge for the District of Oregon, found Cox failed to present evidence that she had any media credentials or affiliation with a "recognized news entity," or that she had checked her facts or tried to contact the other side to "get both sides of the story."

Bob Marley

The half-brother of reggae legend Bob Marley said Thursday he will fight a lawsuit that seeks to stop him from using Marley's name and image without official authorization to promote an annual Miami music festival and other ventures.

Richard Booker, whose mother Cedella Booker was also Marley's, said an internal family dispute should not have escalated into a legal battle. The lawsuit was filed last week on behalf of a Bahamian company that represents Marley's widow, Rita, and nine of the late superstar's children.

The lawsuit, filed in Miami federal court, asks a judge to stop Booker from using Marley's name, image, lyrics and other intellectual property unless he reaches a licensing agreement to do so with the family company, Fifty-Six Hope Road Music Ltd.

Booker's ventures include the "Mama Marley" restaurants in Jamaica. He also has plans to market an offshoot recipe book. The music festival, to be held for the 19th time in March, uses the Nine Mile name that stems from the area where Marley grew up and is now buried. Three of Marley's sons are scheduled to perform, despite the dispute.

Jodie Foster's estranged father faces more than 25 years behind bars after being convicted of bilking more than $100,000 from the poor and elderly in a home-building scheme.

City News Service reports that Lucius Foster was convicted of 21 misdemeanor counts of grand theft after a jury deliberated for about three hours on Wednesday. A Los Angeles judge is scheduled to sentence the 89-year-old on Thursday afternoon.

Lucius Foster was convicted of taking $5,000 each from 21 people for whom he promised to build affordable homes made from cargo containers. The units were never built, and prosecutors alleged he used blatant lies and charm to attract investors.

He acknowledged he remains estranged from his two-time Oscar-winning daughter and was immediately taken into custody after the verdict.

Candace Gingrich-Jones

The gay half-sister of Republican presidential candidate Newt Gingrich slammed his position on gay rights on Wednesday and said she will support President Barack Obama, a Democrat, in the 2012 election.

Candace Gingrich-Jones, a gay rights activist, told MSNBC's Rachel Maddow that she and her older half-brother, the former speaker of the House of Representatives, were "mutually respectful" but disagree on gay rights.

"He is definitely on the wrong side of history when it comes to those issues," Gingrich-Jones said.

She said she would "work really, really hard to make sure that President Obama is re-elected next year no matter who the Republican candidate is."

Fire Strikes

Universal Backlot

A fire erupted Thursday on the Universal backlot, hitting a three-story building near the intersection of Lankershim Boulevard and Cahuenga Boulevard.

According to a spokesperson for the Los Angeles County Fire Department, a report came in at noon that there was a fire on the lot. Fifty-five firefighters fought the blaze.

It was a building already set for demolition, so it was unoccupied and no injuries were reported to either civilians or firefighters.

Fires at the backlot are a part of Universal's history, the most damaging of which came in 2008, when the King Kong attraction was affected.

Pastor Sends Message

Iowa

An evangelical pastor in Iowa sent state voters on Thursday a music video slamming Republican presidential candidate Newt Gingrich for his three marriages and admitted marital infidelities.

Cary Gordon, an influential Sioux City pastor who has endorsed Rick Santorum in the 2012 presidential race, said he would send the satirical hip-hop video to registered Republicans and independents with a cell phone on record.

The video, by independent filmmaker Molotov Mitchell, calls Gingrich the "Kim Kardashian of the GOP," a reference to the reality television star known for her appearance in a sex video and for her failed marriages.

Gordon sent out more than 800,000 texts last week with his endorsement of Santorum, a former U.S. senator.

Diana Colbert

Diana Joy Colbert, the wife of author Charles Bock whose battle with leukemia inspired widespread sympathy and support among the New York literary community, died Thursday. She was 41.

Colbert died in her sleep, according to an email from Bock that his publisher, Random House, shared with The Associated Press. Colbert was first diagnosed two years ago, and a fundraising auction was held in February to help the couple pay medical bills, with Jonathan Franzen, Jonathan Safran Foer and Rick Moody among the authors involved.

Bock's acclaimed debut novel, "Beautiful Children," came out in 2008. His editor, David Ebershoff, noted Thursday that Bock worked on the book for 10 years, "all of them supported by Diana."

"Diana gave Charles the time, the space, the freedom to write," Ebershoff said in a statement. "She also gave him the love that every great writer must have in his or her heart to create. I learned only today that Diana's middle name was Joy. How perfect, and how true."

Colbert grew up in Memphis, Tenn., and graduated from New York University in 1992. She tried different careers, including massage therapy and yoga instruction. At the time of her death, she had been working on a doctorate in English literature at the CUNY Graduate Center.

The fundraiser for Colbert was billed the "World's Most Literary Rent Party Ever!" Wesley Stace, better known as singer-songwriter John Wesley Harding, performed, while bids were taken for some unusual and personal favors. Moody volunteered to write a song, and fellow author A.M. Homes offered to do laundry.

Bock said at the time that he was paying $3,000 a month for health coverage and that he feared "going broke" unless "something changes." Colbert was being treated at the Memorial Sloan-Kettering Cancer Center and was unable to attend.

Bock and Colbert have a daughter, Lily, who turns 3 on Sunday.

Jerry Robinson

Jerry Robinson, a pioneer in the comic book industry who helped create The Joker in the Batman series died Wednesday at age 89.

Charles Kochman, his editor at Abrams Comic Arts, says Robinson brought realism and humor to comics.

Kochman, a New York City resident, worked on a book published last year called "Jerry Robinson, Ambassador of Comics."

As an ambassador for the genre, Robinson fought to win comic artists copyrights to their own work.

A native of Trenton, N.J., he was only 17 when he was hired by Batman creator Bob Kane. In the early 1940s, Robinson contributed images for some of pop culture's greatest icons including The Joker for issue No. 1 of "Batman."

Later in life, Robinson taught at New York's School of Visual Arts.
